 INVITATION FOR BID (One of Two)

The City of Orlando, Florida, will receive sealed bids through the City Clerk, 2nd Floor, City Hall, 400 S. Orange Avenue, Orlando, Florida 32801, for the Malibu Groves Underdrains project on October 21, 2009 at 3:00 p.m. local time at which time bids will be opened and publicly read in Veterans Conference Room, 2nd floor, City Hall

The Contract will consist of construction of underdrain sections in the parkway of selected roads in the Malibu Groves Subdivision and along Timbersound Blvd. The underdrains will be connected to existing storm inlet structures.  Some driveways, sidewalks and utilities will be affected and restoration will be a part of this project.

The estimate for the project is approximately $500,000.

Plans, Specifications & Contract Documents will be open to public inspection after 12 p.m., Monday, September 21, 2009, in the Public Works Department Records Room, 8th Floor, City Hall (phone #407-246-3267).  Plans, Specifications & Contract Documents may be obtained free of charge for the first copy.  Additional copies may be purchased for $20.00, plus tax, per set (non-refundable). Bids must be accompanied by a bid bond, certified check or cashier's check made out to the City of Orlando, or other security as provided by law, in an amount not less than 10% of the total base bid.

Bidders must be appropriately licensed Florida Contractors pursuant to Chapter 489 Florida Statutes to be considered responsible bidders and eligible to be awarded a contract.

A  Pre-Bid Conference will be held October 6, 2009 at 10:00 a.m., in the Group Room, 8th Floor, City Hall.

All questions about the meaning/intent of the Plans & Contract Documents must be submitted in writing before 3:00 P.M., October 14, 2009, to Steve Wiedenbeck, Project Manager, Capital Improvements and Infrastructure Division, 400 S. Orange Ave., 8th Floor, Orlando, Florida 32801.  Questions will be answered in accordance with Article 5 of the "Instruction to Bidders," replies will be given at a later date.

The project is being funded in whole or in part by a Community Development Block Grant (CDBG) from the Department of Housing and Urban Development (HUD).  The Contractor and subcontractors shall be required to comply with applicable federal laws, rules and regulations pertaining to the CDBG program including, but not limited to, Davis-Bacon Act, Equal Employment Opportunity/Executive Order 11246, and the HUD Section 3 clause.

No award of a contract or subcontract can be made at any tier to any party which is debarred or suspended or otherwise excluded from or ineligible for participation pursuant to federal or state requirements.

Upon award of contract, the Low Bidder shall be required to provide Performance and Payment Bonds in the amount of the Contract Price.  The Surety must be licensed to do business in the State of Florida, must be included on the United States Department of the Treasury’s Listing of Approved Sureties, and must have at least an “A-” rating in accordance with the most current A.M. Best Company financial strength ratings.

City of Orlando Minority & Women-Owned Business Enterprise Ordinance

The Contractor shall be required to comply with the City of Orlando's Minority & Women-Owned Business Enterprise Ordinance (Chapter 57).  The Supplementary Conditions establish requirements which must be achieved by the Contractor; certain required actions must be taken at least 10 days prior to bidding.  The MBE/WBE Letters of Intent (see form in Supplementary Conditions) must be provided at the time of bid opening.  If either or both the MBE/WBE goals are not met, MBE/WBE "good faith" documentation must also be provided at the time of bid opening.

Living Wage

CONTRACTOR is required to pay its workers, as well as its subcontractors providing services pursuant to a contract with the CITY, a living wage for the time spent providing services to the CITY.  (This provision does not include general administrative personnel unless they are assigned to a CITY project.)  “Living wage” means compensation for employment of not less than $8.50 per hour for straight time, exclusive of FICA, unemployment taxes, and workers compensation insurance and employee benefits.  This provision shall apply to all bid and proposal awards for services which involve CITY expenditures that exceed $100,000.00 per year.

Responsible Contractor’s Policy

For contracts with an estimated value of at least $100,000, the Contractor will be required to comply with the City of Orlando’s Responsible Contractor’s Policy, which requires that Contractor pay workers on this Project an hourly wage, based on classification for the Orlando region established by the Davis-Bacon Act (hereinafter “hourly wage”).  The Wage Determination for this Project can be found at www.gpo.gov/davisbacon/fl.html.  The applicable county is Orange County, and the construction type is Heavy: Sewer and Water Lines Construction.  Additionally, CONTRACTOR shall provide said workers with health benefits, such   requirement being satisfied by providing to the workers on this project either 1) health benefits through a bona fide program or 2) by increasing their hourly wage by 20%.  If satisfying the health benefits requirement by providing health benefits through a bona fide program, the Supplementary Conditions establish minimum health insurance benefits which must be evidenced by the Contractor.  Moreover, certification as to the existence of a bona fide health benefits program must be provided to the City at the time of the bid opening.

The Owner reserves the right to waive any informalities, to reject any or all Bids, or to re-advertise for Bids.  Awards, if made, will be to the lowest responsive, responsible bidder whose bid is most advantageous to the Owner, price and other factors considered.

Orange Avenue, Orlando, Florida 32801, for Ferguson Drive Improvements on October 28, 2009, at 10:00 am local time, at which time bids will be opened and publicly read in the Agenda Conference Room on the 2nd floor.  The Contract will consist of roadway, drainage and pedestrian facility improvements for Ferguson Drive south of SR50.

The estimate for this project is $265,164.

Plans, Specifications & Contract Documents will be open to public inspection after 10:00 am, October 5, 2009, in the Public Works Department Records Room, 8th Floor, City Hall (phone #407-246-3267).
